CONSENT ORDER LEVYING A FINE AND A COMPLIANCE PLAN fine of $500,000.00 and suspend $250,000.00 based on conditions. The Company provided insufficient information in response to two market scans and subsequent requests for additional and/or revised information, the Company has not yet demonstrated its compliance with state and federal mental health parity laws in the design and application of its NQTLs for prior authorization and provider reimbursement methodology. Therefore, the Insurance Commissioner finds that the Company violated 42 U.S.C. ยง 300gg- 26(a)(8)(A), CAA 2021, WAC 284-43-0140, WAC 284-30-360(2) and WAC 284-30-650, justifying the imposition of a fine under RCW 48.05.185.
