SITE DESCRIPTION

Exxon Co USA 77063 (the Site) is located at 209 Central Way in downtown Kirkland, Washington. The Site is defined by releases of waste oil, diesel, heating oil, and gasoline to soil and groundwater. 
 
The Site was occupied by a former Exxon Station prior to 1990. All of the underground storage tanks (USTs) and associated piping were removed in 1990, and the property was redeveloped and has been occupied by a train toy store since 1994.


CLEANUP ACTIVITIES

Cleanup conducted at the Site included excavation, soil vapor extraction, air sparging, and pump and treat. Following cleanup activities, diesel and gasoline-range petroleum hydrocarbons remain in soils on the property. However, the contaminated soil was isolated from infiltration and from direct human contact by the building, asphalt and concrete pavement, and topsoil in the limited landscaped areas. These covering materials or structures act as a cap. Results from groundwater monitoring have demonstrated that the plume has been contained within the property, and contaminant levels have been below applicable Model Toxics Control Act (MTCA) Method A cleanup levels since 2002.


REGULATORY STATUS

Ecology issued a No Further Action (NFA) determination letter on May 23, 2007 through the Voluntary Cleanup Program (VCP). The NFA determination was contingent upon an environmental covenant, which was filed on the property on April 5, 2007. 

 


PERIODIC REVIEW

A periodic review is conducted every five years following a cleanup action when institutional controls are used as part of the remedy, as required by the Model Toxics Control Act (MTCA). The purpose of the periodic review is to evaluate current site conditions and to ensure continued protection of human health and the environment. 


PERIODIC REVIEW RESULTS

The cleanup actions completed at the Site appear to be protective of human health and the environment.

 
Soil cleanup levels have not been met at the Site; however, the cleanup action is determined to comply with cleanup standards under WAC 173-340-740(6)(f), since the long-term integrity of the containment system is ensured and the requirements for containment technologies have been met. 
 
The environmental covenant for the property is in place and continues to be effective in protecting public health and the environment from exposure to hazardous substances, as well as protecting the integrity of the cleanup action.
 
Based on this periodic review, Ecology has determined that the requirements of the environmental covenant continue to be met. No additional cleanup actions are required by the property owner at this time. It is the property owner’s responsibility to continue to inspect the Site to assure that the integrity of the remedy is maintained.
