Appropriate stream arcs were selected from the Pacific Northwest Hydrographic Framework Water Courses layer. Streams and rivers published in Chapter 173-18-WAC. This layer will not be updated. It is slowly becoming outdated as cities and counties update their list of Shoreline Management Act streams in their shoreline master program. See WAC 173-18-044 posted at <http://apps.leg.wa.gov/wac/default.aspx?cite=173-18-044.The> upstream points where SMA jurisdiction begins were originally compiled for Ecology in 1972 by the US Geological Survey, Water Resources Division, Tacoma, WA, and released in STREAMS OF WASHINGTON UNDER THE REQUIREMENTS OF THE SHORELINE MANAGEMENT ACT OF 1971. Points were determined using multiple-regression techniques based on streamflow and basin precipitation records. Ecology has ocassionally updated those points and added and subtracted SMA streams and portions of SMA streams since 1972.

Washington's Shoreline Management Act (SMA) was passed by the Legislature in 1971 and adopted by the public in a 1972 referendum. The goal of the SMA is "to prevent the inherent harm in an uncoordinated and piecemeal development of the state's shorelines."
The Act establishes a broad policy giving preference to uses that:
* protect the quality of water and the natural environment, * depend on proximity to the shoreline ("water-dependent uses"), and * preserve and enhance public access or increase recreational opportunities for the public along shorelines.
The Shoreline Act establishes a balance of authority between local and state government. Cities and counties are the primary regulators but the state has authority to review local programs and permit decisions. The State's authority is housed in the Department of Ecology.
Under the Act each city and county adopts a shoreline master program that is based on state guidelines but tailored to the specific geographic, economic and environmental needs of the community. Master programs provide policies and regulations addressing shoreline use and protection as well as a permit system for administering the program.
Ecology's role is to provide technical assistance to local government and to assure that local government actions are consistent with the local programs and the overall policy of the Act.
The Act strongly supports public involvement in shoreline decision making. Citizens participate on advisory boards preparing local master programs, and public comment is required for individual permits.
The Shorelines Hearings Board is a quasi-judicial body made up of six members representing citizen interests. Any aggrieved party may appeal a shoreline permit decision to the Shorelines Hearings Board.
Decisions regarding approval of shoreline programs may be appealed to the appropriate regional Growth Hearings Board (if the jurisdiction is planning under the Growth Management Act), or the Shorelines Hearings Board (if the jurisdiction is not planning under the Growth Management Act).
The Shoreline Act applies to:
* all marine waters; * streams with a mean annual flow greater than 20 cubic feet per second; * lakes 20 acres or larger; * Upland areas called "shorelands" 200 feet landward from the edge of these water's;
and the following areas when they are associated with one of the above:
* biological wetlands and river deltas; and * some or all of the 100-year floodplain including all wetlands within the entire floodplain. * The Shoreline Act also states that "the interests of all the people shall be paramount in the management of shorelines of statewide significance." These shorelines are defined in the Act as:
* Pacific Coast, Hood Canal and certain Puget Sound shorelines; * all waters of Puget Sound and the Straight of Juan de Fuca; * lakes or reservoirs with a surface acreage of 1,000 acres or more; * larger rivers (1,000 cubic feet per second or greater for rivers in Western Washington, 200 cubic feet per second and greater east of the Cascade crest); and * wetlands associated with all the above.
